1. Introduction

Welcome to SingWhys. By using our website and/or participating in our private voice lessons, workshops and online courses, you agree to comply with the following terms and conditions. Please read them carefully before using our services.

2. General Information

  • Service Provided: SingWhys offers private voice lessons, workshops and online courses.
  • Location: Private voice lessons will be held in person at 15 Walsh Street, Milton, QLD, Australia or online using Zoom or Skype. Workshops will be held in person and all associated details will be available via the SingWhys website. Online courses will be available to purchase online via the SingWhys website.
  • Duration: Lessons, workshops and online courses will all have their retrospective prices and durations advertised before purchase.

3. Booking and Enrolment

  • Lesson Registration: To book a private voice lesson, students can simply go to the Private Lessons page on the SingWhys website and follow the steps in choosing a lesson duration, time and day that suits them best. The booking software will lead them through a short series of steps before they secure their lesson by finalising payment. Upon finalising the booking, information regarding the studio location and what to bring or prepare for the lesson will be automatically sent out to the volunteered phone number and/or email address.
  • Lesson Duration: Each private voice lesson will be either 30 minutes, 45 minutes or 60 minutes in duration unless otherwise agreed upon.
  • Lesson Frequency: Private voice lessons are typically offered on a weekly, bi-weekly, monthly or casual basis unless otherwise agreed upon. It is recommended that students commit to regular attendance for optimal progress.
  • Scheduling: Lessons must be scheduled in advance, subject to instructor availability.
  • Workshop Registration: To buy a ticket to a workshop, singers can go to the Workshop page on the SingWhys website and follow the prompts for upcoming workshop information.
  • Online Course Registration: To purchase an online course, singers can go to the Courses page of the SingWhys website and follow the prompts for the online course/s that they wish to purchase.

In order to book our services you must provide accurate contact information details as SingWhys is not responsible for delays or issues caused by incorrect details.

4. Payment Terms

  • Fees: Casual lesson fees are displayed on the Private Lessons page of the SingWhys website at all times. Regular fees are discounted and given upon request. Fees must be paid in advance or upon completion of the lesson unless a prior agreement is made. Workshops and online course fees must be paid in advance.
  • Payment Methods: Accepted payment methods include bank transfer, credit card, PayPal or cash. A receipt can be provided after each payment if required.
  • Late Payment: Any late payments may be subject to a late fee. Continued non-payment may result in suspension or cancellation of lessons.

5. Cancellation and Rescheduling Policy

  • Cancellation by Student: Students must notify the teacher at least 24 hours in advance if they need to cancel or reschedule a lesson. Lessons cancelled with less notice may be charged in full.
  • Cancellation by Teacher: If the teacher needs to cancel or reschedule a lesson, the student will be given at least 24 hours’ notice and the lesson will either be rescheduled or refunded.
  • No-Show: If a student fails to attend a lesson without prior notice they will be charged for the full lesson.
  • Emergency Cancellations: In cases of emergency (e.g. illness), the student may be allowed to reschedule the lesson at the discretion of the teacher.
  • Make-Up Lessons: Make-up lessons may be offered based on instructor availability. No guarantee of a make-up lesson is made for cancellations.
  • Workshops: No refunds are given for workshops.
  • Online Courses: No refunds are given for online courses.

6. Student Responsibilities

  • Punctuality: Students should arrive on time for their lessons. Late arrivals will not receive extra time and the lesson will end at the scheduled time.
  • Preparation: Students are expected to come to each lesson prepared, having practiced the material discussed in previous lessons. If you have any specific goals or pieces you would like to work on, please inform the teacher in advance.
  • Materials: Students must bring all necessary materials (e.g. music books, sheet music, notebook) to each lesson.
  • Behaviour: Students are expected to maintain respectful behaviour during lessons. Disruptive or disrespectful behaviour may result in termination of lessons.
  • Practice: Regular practice is essential for progress. While it may not always be monitored by the teacher, the student’s commitment to practice will significantly affect their progress.

7. Teacher Availability

  • Scheduling: Teachers will make every effort to accommodate students’ preferred lesson times but scheduling may be subject to teacher availability.
  • Substitute Teachers: In case of an emergency, SingWhys reserves the right to substitute another qualified teacher for a lesson.

8. Privacy and Confidentiality

  • Personal Information: All personal information shared by the student will be kept confidential and used solely for administrative purposes, lesson scheduling and communication, except where required by Australian Law.
  • Recording Lessons: Recording lessons (audio/video) is not allowed without prior consent from the teacher and/or student. Unless it has been agreed upon, the recordings may only be used for personal study purposes and not shared publicly.
  • Third Parties: SingWhys will keep all personal information confidential and will not share any student data with third parties without prior consent, except where required by Australian Law.

9. Code of Conduct

  • Respect and Behaviour: All students are expected to behave respectfully towards their teachers and each other during lessons and/or at any events organized by SingWhys.
  • Disruptive Behaviour: SingWhys reserves the right to terminate lessons or workshop participation for disruptive behaviour or actions that interfere with the learning environment.

10. Health and Safety

  • Medical Conditions: Students should inform their teacher of any relevant medical conditions (e.g. physical limitations, vocal injuries, allergies) that may affect their ability to participate in lessons.
  • Voice/Instrument Safety: Students are responsible for the care and safety of their own voice/instruments and SingWhys is not liable for any loss, damage or injury related to the use of students’ voices/instruments during lessons, workshops or online courses.
  • Medical Information: The student (or parent/guardian if applicable) must inform SingWhys of any medical conditions or special needs that may affect lessons or workshops.
  • Covid-19/Illness Policy: If a student is sick, they are strongly encouraged to reschedule their lesson. Online lessons may be offered in place of in-person lessons if the student or teacher is unwell.

11. Liability and Insurance

  • Limitation of Liability: SingWhys is not liable for any injuries, accidents or loss of personal belongings that may occur during lessons, events or while on the premises.
  • Insurance: It is recommended that students have appropriate insurance coverage for their personal property and any injuries that may occur during their lessons.
  • Safety: The teachers at SingWhys will not be held responsible for any injuries or accidents that occur during lessons, whether in person or online. It is the student’s responsibility to ensure they have proper instrument handling and safety procedures in place.

12. Termination of Lessons

  • Student Withdrawal: Students may withdraw from private lessons at any time. Any remaining balance will be refunded (if applicable).
  • Termination by SingWhys: SingWhys reserves the right to terminate lessons if the terms and conditions are not followed or if there are concerns about a student’s progress, behaviour, or attitude.
  • Termination for Non-Payment: Failure to make payment as outlined in section 4 may result in suspension or termination of lessons.

13. Third-Party Websites

  • Our website may contain links to third-party websites or services that are not owned or controlled by SingWhys. SingWhys is not responsible for the content, privacy policies or practices of any third-party websites.

14. Intellectual Property

  • All content on the SingWhys website, including but not limited to text, images, logos, and graphics, is the property of SingWhys or its licensors. You may not reproduce, distribute or otherwise use any content from this website without express permission from SingWhys.

15. Changes to Terms and Conditions

  • SingWhys reserves the right to modify or update these Terms and Conditions at any time without notice. Any changes will be posted on this page with an updated “Effective Date” and continued use of the website constitutes acceptance of the revised terms.

16. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from or related to the use of the SingWhys website or any of our services will be subject to the exclusive jurisdiction of the legal processes in Queensland, Australia.
